Durch den Zugriff auf die Website, die Erstellung eines Kontos, die Einreichung einer Angebotsanfrage oder die Aufgabe einer Bestellung bestätigt der Nutzer, dass er diese Allgemeinen Geschäftsbedingungen gelesen und akzeptiert hat, soweit sie auf den genutzten Dienst anwendbar sind.

Die Plattform kann auch Zusatzleistungen anbieten, wie die Identifizierung eines Teils anhand der Fahrgestellnummer (VIN), des OE/OEM-Codes, des Motorkennbuchstabens, der Marke/des Modells oder anderer vom Kunden bereitgestellter technischer Daten sowie die Anforderung von Angeboten oder Informationen über Aufbereitungs- und technische Dienstleistungen.

3. Produktinformationen

Wir bemühen uns nach besten Kräften, die angezeigten Beschreibungen, Bilder, Artikelnummern, Preise, Lagerbestände und technischen Informationen korrekt und aktuell zu halten. Da einige Informationen jedoch von Herstellern, Händlern oder externen technischen Datenbanken stammen können, sind Abweichungen in der Darstellung, verzögerte Aktualisierungen oder wesentliche Fehler möglich.

Eine Suche allein anhand von Modellname, Hubraum, Leistung oder Baujahr reicht möglicherweise nicht für eine genaue Identifizierung aus. 11. Gewährleistungen und Konformität der Ware

Petrăchioaia, Jud. Ilfov, registered with the Trade Register under no. J23/6100/2017, CUI 38581610, hereinafter referred to as “EngineParts”, “we”, “the operator” or “the seller”.

By accessing the website, creating an account, submitting a request for a quote or placing an order, the user confirms that he has read and accepts these Terms and Conditions, to the extent that they are applicable to the service used.

2. Purpose of the platform

EngineParts sells and/or displays engine parts and components, including, subject to availability, OE/OEM products, aftermarket, professionally reconditioned products, used products, subassemblies and complete engines.

The platform can also offer ancillary services such as identifying a part by chassis series (VIN), OE/OEM code, engine code, make/model or other technical data provided by the customer, as well as request for quotes or information about reconditioning and technical services.

3. Product information

We make reasonable efforts to ensure that the descriptions, images, codes, prices, stock and technical information displayed are accurate and up-to-date. However, some information may come from manufacturers, distributors or external technical databases and there may be differences in presentation, delayed updates or material errors.

Product photos are, where applicable, for informational purposes. The shade, labels, packaging or certain visual details may differ without this difference modifying the essential characteristics of the ordered product.

If we identify an obvious error regarding price, stock, product code or description before accepting the order, we will inform the customer and request that the order be reconfirmed under the correct conditions.

4. Compatibility, VIN and OE/OEM codes

In the field of auto parts, compatibility can depend on several elements: VIN series, engine code, year of manufacture, equipment version, OE/OEM code, manufacturer's technical revisions and other vehicle specifics.

The customer must provide correct and complete data when requesting a compatibility check. We recommend submitting the full VIN and, if available, the part number fitted to the vehicle.

A search solely by model name, displacement, power or year may not be sufficient for accurate identification. When additional verification is requested on the product page or in the discussion with our team, the order should only be completed after confirmation of compatibility.

5. User account

7. Pricing, billing and payment

The prices displayed on the website are those applicable at the time of placing the order, except for obvious errors. Information regarding VAT, taxes and delivery costs will be presented according to the commercial configuration applicable to the order.

The available payment methods are those displayed during the checkout process. Depending on the method, payment may be processed through authorized third-party providers, according to their own terms and security measures.

8. Delivery

If EngineParts at any time offers a commercial return period that is longer than the legal term, this represents an additional benefit and applies according to the conditions published in the Return Policy, without limiting the consumer's legal rights.

10. Exceptions to withdrawal

The right of withdrawal does not apply in situations exempted by law. These may include, depending on the specific situation, goods made to the consumer's specifications or clearly personalized and other cases provided for in art. 16 of GEO no. 34/2014.

Simply identifying a part by VIN does not automatically mean that the product is personalized and does not, by itself, eliminate the legal right of withdrawal.

In the case of a reconditioning work performed specifically on a component provided by the customer or a product made/modified on request, the specific conditions will be communicated before acceptance of the work.

11. Warranties and conformity of goods

For consumers, legal rights regarding the conformity of goods apply, including the provisions of GEO No. 140/2021, to the extent that they are applicable to the product and the specific legal relationship.

In addition, some products may benefit from commercial warranties offered by EngineParts, the manufacturer, reconditioner or supplier. The duration and conditions of the commercial warranty are those communicated for the respective product and do not reduce the consumer's legal rights.

To resolve a warranty claim, we may request information and documents reasonably necessary for analysis, such as the invoice/order, product series, photographs, technical findings, proof of installation or other relevant data, depending on the nature of the part and the problem complained about.

Defects caused exclusively by improper assembly, use contrary to specifications, lack of lubrication, contamination, overheating, unauthorized interventions or other external causes can be analyzed separately, without affecting legal rights that cannot be limited by contract.

12. Refurbished and second-hand products

When a product is refurbished or second-hand, this must be indicated on the product page, offer or commercial confirmation. Such products may show aesthetic marks or peculiarities resulting from previous use, without these necessarily representing non-conformities.

The essential characteristics, condition, commercial guarantee, if any, and any special conditions will be communicated appropriately for each product or category.

13. Assembly and technical responsibility

Engine parts are technical components that may require measurements, adjustments, circuit cleaning, replacement of consumables, assembly procedures and subsequent checks specific to the vehicle manufacturer.

We recommend that the installation be carried out by qualified personnel and in accordance with the applicable technical documentation. The general information published on the website or blog does not replace the diagnosis and workshop procedure for the specific vehicle.

14. Website content and intellectual property

The texts, graphic elements, logos, structure, own photographs, video materials, databases and other elements of the website are protected by intellectual property legislation, to the extent that they belong to EngineParts or are used legally.

Normal use of the website for legitimate personal and commercial purposes is permitted. Systematic copying, republication, massive automatic extraction, reproduction or use of the content to create a competing database without permission is prohibited, except as permitted by law.

15. Reasonable limitation of liability

EngineParts cannot be held responsible for temporary website interruptions, unavailability of external services or delays caused by events beyond its reasonable control, without affecting consumers' rights under the law.

Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited by law.

16. Reviews, messages and user-submitted content

When you submit a review, comment, photo, or other content through the platform, you must have the right to transmit that material and not infringe on the rights of others. Material that is illegal, misleading, defamatory, abusive, discriminatory, unsolicited advertising, or contains malicious code is not permitted.

We may moderate or remove content that violates these rules or the law.

18. Modification of terms

1. Despre EngineParts

Website-ul engineparts.ro și serviciile asociate sunt operate de RECOTECH INDUSTRIAL SRL, societate înregistrată în România, cu sediul social în Șos. Gagu nr. 170, Sat Vînători, Com. Petrăchioaia, Jud. Ilfov, înregistrată la Registrul Comerțului sub nr. J23/6100/2017, CUI 38581610, denumită în continuare „EngineParts”, „noi”, „operatorul” sau „vânzătorul”.

Prin accesarea website-ului, crearea unui cont, transmiterea unei solicitări de ofertă sau plasarea unei comenzi, utilizatorul confirmă că a citit și acceptă acești Termeni și condiții, în măsura în care aceștia sunt aplicabili serviciului folosit.

2. Obiectul platformei

EngineParts comercializează și/sau prezintă piese și componente pentru motoare, inclusiv, în funcție de disponibilitate, produse OE/OEM, aftermarket, produse recondiționate profesional, produse second-hand, subansamble și motoare complete.

Platforma poate oferi și servicii auxiliare precum identificarea unei piese după seria de șasiu (VIN), cod OE/OEM, cod motor, marcă/model sau alte date tehnice furnizate de client, precum și solicitări de ofertă ori informații despre recondiționare și servicii tehnice.

3. Informațiile despre produse

Depunem eforturi rezonabile pentru ca descrierile, imaginile, codurile, prețurile, stocurile și informațiile tehnice afișate să fie corecte și actualizate. Totuși, anumite informații pot proveni de la producători, distribuitori sau baze de date tehnice externe și pot exista diferențe de prezentare, actualizări întârziate ori erori materiale.

Fotografiile produselor au, după caz, caracter informativ. Nuanța, etichetele, ambalajul sau anumite detalii vizuale pot diferi fără ca această diferență să modifice caracteristicile esențiale ale produsului comandat.

În cazul în care identificăm o eroare evidentă privind prețul, stocul, codul produsului sau descrierea înainte de acceptarea comenzii, vom informa clientul și vom solicita reconfirmarea comenzii în condițiile corecte.

4. Compatibilitate, VIN și coduri OE/OEM

În domeniul pieselor auto, compatibilitatea poate depinde de mai multe elemente: seria VIN, codul motor, anul de fabricație, versiunea de echipare, codul OE/OEM, reviziile tehnice ale producătorului și alte particularități ale vehiculului.

Clientul trebuie să furnizeze date corecte și complete atunci când solicită o verificare de compatibilitate. Recomandăm transmiterea VIN-ului complet și, dacă este disponibil, a codului piesei montate pe vehicul.

O căutare realizată exclusiv după denumirea modelului, cilindree, putere sau an poate să nu fie suficientă pentru identificarea exactă. Atunci când în pagina produsului sau în discuția cu echipa noastră este solicitată o verificare suplimentară, comanda ar trebui finalizată numai după confirmarea compatibilității.

5. Contul de utilizator

Pentru anumite funcții poate fi necesară crearea unui cont. Utilizatorul este responsabil pentru corectitudinea datelor introduse și pentru păstrarea confidențialității datelor de autentificare.

Dacă observi o utilizare neautorizată a contului, te rugăm să ne contactezi cât mai repede. Putem suspenda temporar accesul unui cont atunci când există indicii rezonabile de fraudă, compromitere sau utilizare abuzivă.

6. Plasarea și acceptarea comenzii

Adăugarea unui produs în coș și transmiterea comenzii reprezintă o solicitare de cumpărare. Contractul de vânzare se consideră încheiat atunci când comanda este acceptată de EngineParts și clientul primește confirmarea corespunzătoare, în funcție de fluxul tehnic și comercial folosit.

Pentru produse cu disponibilitate variabilă, produse la comandă, motoare complete, piese recondiționate sau alte repere care necesită validare, putem contacta clientul înainte de acceptarea finală pentru confirmarea compatibilității, prețului, disponibilității, termenului sau condițiilor specifice.

Ne rezervăm dreptul de a refuza o comandă în cazuri justificate, de exemplu: produs indisponibil, eroare evidentă de preț, date insuficiente pentru validarea unei piese, suspiciune rezonabilă de fraudă ori imposibilitatea obiectivă de executare.

7. Prețuri, facturare și plată

Prețurile afișate pe website sunt cele aplicabile în momentul plasării comenzii, cu excepția erorilor evidente. Informația privind TVA-ul, taxele și costurile de livrare va fi prezentată conform configurației comerciale aplicabile comenzii.

Metodele de plată disponibile sunt cele afișate în procesul de checkout. În funcție de metodă, plata poate fi procesată prin furnizori terți autorizați, conform propriilor condiții și măsuri de securitate ale acestora.

Factura este emisă pe baza datelor furnizate de client. Clientul este responsabil să verifice corectitudinea datelor de facturare înainte de finalizarea comenzii.

8. Livrare

Livrarea se efectuează prin metodele și operatorii disponibili la momentul comenzii. Termenele de livrare afișate sunt estimative, cu excepția cazului în care este indicat expres un termen ferm.

Pentru produsele disponibile în stoc, expedierea poate fi realizată într-un interval mai scurt decât pentru produsele la comandă. Termenul efectiv poate depinde de destinație, curier, furnizor, verificări suplimentare de compatibilitate și zile nelucrătoare.

La primirea coletului, recomandăm verificarea integrității ambalajului. Dacă există deteriorări vizibile, acestea trebuie semnalate curierului și către EngineParts cât mai curând posibil, împreună cu fotografii și documente relevante.

9. Dreptul de retragere al consumatorului

Dacă ești consumator și contractul a fost încheiat la distanță, beneficiezi de dreptul legal de retragere în condițiile Ordonanței de urgență nr. 34/2014, de regulă într-un termen de 14 zile calendaristice, fără a fi necesară justificarea deciziei, sub rezerva excepțiilor prevăzute de lege.

Pentru exercitarea dreptului de retragere ne poți transmite o declarație neechivocă prin canalele de contact disponibile pe website. Detaliile operaționale privind adresa de retur, documentele, condiția produsului și pașii de procesare sunt descrise în Politica de retur.

Dacă EngineParts oferă la un moment dat o perioadă comercială de retur mai extinsă decât termenul legal, aceasta reprezintă un beneficiu suplimentar și se aplică potrivit condițiilor publicate în Politica de retur, fără a limita drepturile legale ale consumatorului.

10. Excepții de la retragere

Dreptul de retragere nu se aplică în situațiile exceptate de lege. Acestea pot include, în funcție de situația concretă, bunuri realizate după specificațiile consumatorului sau personalizate în mod clar și alte cazuri prevăzute de art. 16 din OUG nr. 34/2014.

Simpla identificare a unei piese după VIN nu înseamnă automat că produsul este personalizat și nu elimină, prin ea însăși, dreptul legal de retragere.

În cazul unei lucrări de recondiționare executate special asupra unei componente furnizate de client sau al unui produs realizat/modificat la cerere, condițiile specifice vor fi comunicate înainte de acceptarea lucrării.

11. Garanții și conformitatea bunurilor

Pentru consumatori se aplică drepturile legale privind conformitatea bunurilor, inclusiv dispozițiile OUG nr. 140/2021, în măsura în care acestea sunt aplicabile produsului și raportului juridic concret.

În plus, unele produse pot beneficia de garanții comerciale oferite de EngineParts, producător, recondiționator sau furnizor. Durata și condițiile garanției comerciale sunt cele comunicate pentru produsul respectiv și nu reduc drepturile legale ale consumatorului.

Pentru soluționarea unei reclamații de garanție putem solicita informații și documente rezonabil necesare pentru analiză, precum factura/comanda, seria produsului, fotografii, constatare tehnică, dovada montajului sau alte date relevante, în funcție de natura piesei și a problemei reclamate.

Defecțiunile provocate exclusiv de montaj necorespunzător, utilizare contrară specificațiilor, lipsa lubrifierii, contaminare, supraîncălzire, intervenții neautorizate ori alte cauze externe pot fi analizate distinct, fără a afecta drepturile legale care nu pot fi limitate prin contract.

12. Produse recondiționate și second-hand

Atunci când un produs este recondiționat sau second-hand, acest lucru trebuie indicat în pagina produsului, ofertă sau confirmarea comercială. Astfel de produse pot prezenta urme estetice ori particularități rezultate din utilizarea anterioară, fără ca acestea să reprezinte neapărat neconformități.

Caracteristicile esențiale, starea, garanția comercială, dacă există, și eventualele condiții speciale vor fi comunicate în mod corespunzător pentru fiecare produs sau categorie.

13. Montaj și responsabilitatea tehnică

Piesele de motor sunt componente tehnice care pot necesita măsurători, reglaje, curățarea circuitelor, înlocuirea consumabilelor, proceduri de montaj și verificări ulterioare specifice producătorului vehiculului.

Recomandăm ca montajul să fie realizat de personal calificat și conform documentației tehnice aplicabile. Informațiile generale publicate pe website sau blog nu înlocuiesc diagnosticul și procedura de atelier pentru vehiculul concret.

14. Conținutul website-ului și proprietatea intelectuală

Textele, elementele grafice, logo-urile, structura, fotografiile proprii, materialele video, bazele de date și celelalte elemente ale website-ului sunt protejate de legislația privind proprietatea intelectuală, în măsura în care aparțin EngineParts sau sunt utilizate legal.

Este permisă utilizarea normală a website-ului în scop personal și comercial legitim. Copierea sistematică, republicarea, extragerea automată masivă, reproducerea sau utilizarea conținutului pentru crearea unei baze de date concurente fără permisiune sunt interzise, cu excepția situațiilor permise de lege.

15. Limitarea rezonabilă a răspunderii

EngineParts nu poate fi ținut responsabil pentru întreruperi temporare ale website-ului, indisponibilitatea unor servicii externe sau întârzieri cauzate de evenimente aflate în afara controlului rezonabil, fără a afecta drepturile consumatorilor prevăzute de lege.

Nicio clauză din acești Termeni nu exclude sau limitează răspunderea în cazurile în care o astfel de excludere sau limitare este interzisă prin lege.

16. Recenzii, mesaje și conținut transmis de utilizatori

Atunci când trimiți o recenzie, un comentariu, o fotografie sau alt conținut prin platformă, trebuie să ai dreptul de a transmite acel material și să nu încalci drepturile altor persoane. Nu sunt permise materiale ilegale, înșelătoare, defăimătoare, abuzive, discriminatorii, publicitare nesolicitate sau care conțin cod malițios.

Putem modera sau elimina conținutul care încalcă aceste reguli ori legea.

17. Protecția datelor și cookie-uri

Prelucrarea datelor cu caracter personal este descrisă în Politica de confidențialitate. Utilizarea cookie-urilor și tehnologiilor similare este descrisă în Politica de cookies și poate fi configurată prin centrul de preferințe disponibil pe site.

18. Modificarea termenilor

Putem actualiza periodic acești Termeni pentru a reflecta modificări legislative, comerciale sau tehnice. Versiunea aplicabilă unei comenzi este, în principiu, versiunea în vigoare la momentul încheierii contractului respectiv.

19. Legea aplicabilă și soluționarea disputelor

Acești Termeni sunt guvernați de legea română, fără a aduce atingere normelor imperative de protecție de care beneficiază consumatorul potrivit legii aplicabile.

Înainte de inițierea unui litigiu, încurajăm soluționarea amiabilă prin contactarea echipei EngineParts. Consumatorii se pot adresa și autorităților competente, inclusiv Autorității Naționale pentru Protecția Consumatorilor, în condițiile legii.
